Terms of Service
Using Rockstar SMS means you agree to these Terms. We may update them on this page.
The service
Rockstar SMS provides a web desk, contact lists, and delivery of SMS and email to people who opted in. We process your messages and hand SMS to the carrier (and Twilio, when configured). We do not control final carrier delivery and do not guarantee a specific delivery time. Message contents are treated as having zero monetary value for liability purposes.
Usage
You represent that every number you message has opted in. You will remove anyone who opts out immediately. You will follow TCPA, FTC, FCC, and Do-Not-Call rules. We are not your lawyer. If you are unsure, talk to one before you send.
You will not: send spam or unsolicited marketing; harvest numbers without consent; impersonate others; send unlawful, harassing, or infringing content; attack the service; or do anything that could create legal exposure for Rockstar SMS.
You keep rights to your content. You grant us a license to store and transmit it in order to run the service.
No warranty
THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE. ROCKSTAR SMS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW. OUR TOTAL LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED FEES YOU PAID IN THE MONTH OF THE FIRST CLAIM (currently the service is provided without a monthly fee unless separately agreed).
Indemnity
You will defend and indemnify Rockstar SMS against claims arising from your use of the service or your breach of these Terms, including TCPA claims about messages you sent.
